Terms of Service
These terms are an agreement between you and the Playback team about using Playback on the web and in our apps. By creating an account or using Playback, you agree to them, including the Community guidelines. Playback has no tolerance for objectionable content or abusive users.
Who can use Playback
- You must be at least 13. If you’re under 18, or under the age of majority where you live, a parent or guardian must agree to these terms for you.
- Use your real email address, keep your password to yourself, and tell us if you think someone else is using your account. You’re responsible for what happens on your account.
- You can’t use Playback if we’ve suspended your account before, or if the law doesn’t allow you to.
Your content
You own what you post: reviews, ratings, lists, posts, replies and your profile. You give us permission to store, display and share it inside Playback, as needed to run the service. That permission ends when you delete the content or your account, except for copies in short-lived backups. Only post things you have the right to share.
Community guidelines
Keep it about the music. Be curious, give credit, and disagree with the take, not the person. These aren’t allowed:
- Harassment, bullying, threats, or encouraging anyone to hurt themselves.
- Hate speech, slurs, or attacks on people for their race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender identity, disability or serious illness.
- Sexual content or nudity. Anything that sexualizes a minor is removed immediately, the account is banned, and it’s reported to the authorities.
- Glorifying violence, or promoting illegal activity.
- Spam, scams, fake accounts, or impersonating someone.
- Sharing someone’s private information, such as their address, phone number or private messages.
- Copyright infringement, such as posting complete song lyrics or links to pirated music.
- Malware, phishing, or anything meant to break or overload Playback.
Playback automatically blocks some words. To report something, use the ⋯ menu on a post, review, reply, list or profile. To stop seeing someone, block them from the same menu. Blocked people aren’t told. We aim to review reports within two days.
Moderation
We can remove or hide content, and suspend or close accounts, that break these terms or put people at risk, with or without notice. If you think we got it wrong, email privacy@yourdomain.com to appeal.
Using Playback fairly
Don’t scrape or copy Playback in bulk, get into other people’s accounts, get around our security or rate limits, or reverse engineer the service, except where the law allows it.
Music information
Album and song details, cover art and previews come from Apple’s public music catalog and belong to their owners. Playback isn’t affiliated with or endorsed by Apple, Spotify, Google, or any artist or label. Ratings and reviews are members’ own opinions.
Copyright complaints
If you think something on Playback infringes your copyright, email privacy@yourdomain.com with: the work, where it appears on Playback, your contact details, a statement that you believe in good faith the use isn’t authorized, and a statement, under penalty of perjury, that your notice is accurate and that you own the rights or are authorized to act for the owner. We’ll remove infringing content and close the accounts of repeat infringers.
Ending your account
You can delete your account at any time from your profile (how to delete it). We can suspend or end your access if you break these terms. Sections that by their nature should keep applying, such as disclaimers and limits on liability, continue after your account ends.
Disclaimers
Playback is provided “as is” and “as available.” To the extent the law allows, we make no warranties, express or implied, including that Playback will always be available, error-free or secure, or that content posted by members is accurate.
Limits on liability
To the extent the law allows, the Playback team won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, arising from your use of Playback. Our total liability for any claim about Playback is limited to US $50. Some places don’t allow these limits, so they may not apply to you.
Law and disputes
These terms are governed by the laws of Texas, United States, without regard to conflict-of-law rules, and disputes will be handled in the state or federal courts located there. If you live somewhere that gives you the right to bring claims in your local courts or under your local law, nothing here takes that away.
App stores
If you got Playback from Apple’s App Store or Google Play, these terms are between you and the Playback team, not Apple or Google, and the store’s own terms also apply. Apple and Google aren’t responsible for Playback or its content, or for support.
Changes to these terms
When we change these terms, we’ll update the date at the top. If a change is significant, we’ll tell you in Playback or by email before it takes effect. If you keep using Playback after that, you accept the new terms.
